OVERVIEW

Welcome to Kelvetic Online Shop.

The terms "Kelvetic", "we", "us", and "our" refer to Kelvetic Online Shop.

We operate this online store and website, including its products, content, features, and services (collectively, the "Services").

Our store is powered by Shopify.

These Terms of Service ("Terms"), together with our Privacy Policy, Return & Refund Policy, Shipping Policy, and other policies referenced through our Services, govern your use of the Services and purchases from Kelvetic.

By accessing our Services or placing an order, you agree to these Terms.

1. ELIGIBILITY AND ACCOUNTS

You may use our Services only where you are legally capable of entering into the applicable transaction.

You agree to provide accurate, complete, and current information when using our Services.

You are responsible for protecting account credentials and activity occurring through your account.

2. PRODUCTS

We make reasonable efforts to display and describe our products accurately.

Colors, textures, dimensions, print placement, appearance, and other characteristics may differ slightly from digital images because of screens, devices, materials, printing methods, manufacturing processes, and other production factors.

Product mockups and marketing visuals may be illustrative.

Normal production variations do not automatically constitute defects.

Nothing in this section removes rights relating to genuinely defective, damaged, incorrect, or materially non-conforming products where applicable law provides such rights.

3. PRINT-ON-DEMAND PRODUCTION

Many Kelvetic products are made to order using print-on-demand manufacturing.

Production generally begins only after an order has been submitted and accepted.

We use third-party production and fulfillment providers, including Printful.

Products may be manufactured and shipped from different facilities worldwide depending on product availability, destination, capacity, and other operational considerations.

Because products may enter production shortly after purchase, orders may not be changeable or cancellable once production begins.

4. AI-ASSISTED DESIGNS AND CONTENT

Some Kelvetic designs, artwork, illustrations, product visuals, advertising materials, models, videos, images, or other creative content may be created, developed, edited, or enhanced using artificial intelligence.

AI-generated or digitally created people, scenes, environments, and product presentations used in advertising or marketing may be illustrative and may not depict actual persons or locations.

We make reasonable efforts to ensure that our product listings accurately describe the material characteristics of the physical products offered for sale.

Use of artificial intelligence in our creative or marketing processes does not affect mandatory consumer rights applicable to a purchase.

5. ORDERS

Submitting an order constitutes an offer to purchase.

We reserve the right to accept, reject, hold, verify, or cancel orders where permitted by applicable law.

Reasons may include:

• product unavailability;

• pricing or listing errors;

• payment failure;

• suspected fraud;

• unauthorized transactions;

• security concerns;

• shipping restrictions;

• inaccurate customer information; or

• legal or regulatory requirements.

If we cancel an order after collecting payment and no amount is otherwise due, the relevant amount will be refunded.

Customers are responsible for reviewing their product, size, color, quantity, personalization, shipping address, and other order details before submitting an order.

6. FRAUD AND ORDER VERIFICATION

We reserve the right to review orders for fraud, unauthorized payment activity, abuse, or security risks.

We may use information and fraud indicators provided by Shopify, payment processors, carriers, and other service providers.

We may request additional information reasonably necessary to verify an order.

We may decline or cancel orders we reasonably believe to be fraudulent, unauthorized, unlawful, abusive, or materially risky.

7. PRICES, PAYMENT, TAXES AND CUSTOMS

Prices are displayed in the currency shown through our store.

Shipping costs and applicable taxes collected by us will be shown during checkout where applicable.

International orders may be subject to import taxes, customs duties, brokerage fees, handling charges, or other charges imposed by governments, customs authorities, carriers, or other third parties.

Unless expressly stated otherwise or required by applicable law, such charges are the responsibility of the recipient.

Customers are responsible for providing valid and authorized payment information.

8. SHIPPING, DELIVERY AND RISK OF LOSS

Production and delivery dates are estimates unless expressly guaranteed.

Once an order has been handed over to the applicable carrier, postal operator, courier, or other delivery provider, risk of loss, theft, damage, delay, misdelivery, or other events affecting the shipment passes to the customer to the fullest extent permitted by applicable law.

To the fullest extent permitted by applicable law, Kelvetic is not liable for loss, theft, delay, damage, misdelivery, failed delivery, or other events occurring after the shipment has been transferred to the carrier.

Where mandatory applicable law requires risk to remain with Kelvetic for a longer period, that mandatory rule will apply only to the extent required.

Delivery delays caused by carriers, customs, fulfillment providers, weather, strikes, transportation disruptions, governmental action, force majeure, or other circumstances outside our reasonable control do not automatically entitle the customer to compensation except where required by applicable law.

Where carrier tracking confirms delivery to the shipping address supplied with the order, the shipment will generally be considered successfully delivered.

9. CUSTOMER SHIPPING RESPONSIBILITIES

Customers are responsible for providing a complete and accurate shipping address.

Kelvetic is not responsible, to the fullest extent permitted by law, for failed deliveries, delays, losses, or costs resulting from incorrect, incomplete, or outdated customer-provided shipping information.

Customers are responsible for monitoring available tracking information and collecting shipments where required.

Orders returned because of incorrect addresses, refusal, failure to collect, or other circumstances attributable to the customer may require payment of additional shipping and handling charges before reshipment.

10. RETURNS AND REFUNDS

Returns, refunds, exchanges, damaged products, missing shipments, and related claims are governed by our Return & Refund Policy.

Because products are generally made to order, we do not provide a voluntary global return or exchange right for buyer's remorse, incorrect size selection, incorrect color selection, or change of mind.

Where mandatory law provides a non-waivable cancellation, withdrawal, warranty, or return right, we will comply with that requirement.

11. INTELLECTUAL PROPERTY

Our branding, logos, website content, original text, graphics, photographs, videos, artwork, product designs, and other content are owned by or licensed to Kelvetic to the extent applicable intellectual property rights exist.

Some content may have been developed using artificial intelligence. We do not claim exclusive intellectual property rights over material that is not legally eligible for such protection.

You may not reproduce, commercially exploit, distribute, or republish protected Kelvetic content without permission except where permitted by applicable law.

Third-party trademarks and intellectual property remain the property of their respective owners.

12. THIRD-PARTY SERVICES

Our Services rely on third-party providers including Shopify, Printful, payment processors, manufacturers, shipping carriers, analytics providers, and other service providers.

We are not responsible for independent third-party websites, content, or services outside our control.

13. RELATIONSHIP WITH SHOPIFY

Our store is powered by Shopify.

Purchases from Kelvetic are transactions between the customer and Kelvetic, not between the customer and Shopify.

Shopify provides technology supporting our store but is not the seller of Kelvetic products.

14. PRIVACY

Personal information is processed according to our Privacy Policy.

Please review that Policy for information concerning Shopify, Printful, payment providers, advertising technologies, shipping providers, international processing, and your privacy rights.

15. USER CONTENT AND FEEDBACK

If you submit reviews, photographs, comments, suggestions, or other content to us, you confirm that you have the necessary rights to submit it.

You grant Kelvetic a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and publish such content for operating, improving, and promoting our Services, subject to applicable law.

You may not submit fraudulent, misleading, unlawful, defamatory, infringing, malicious, or abusive content.

16. ERRORS AND INACCURACIES

Our Services may occasionally contain errors relating to prices, descriptions, availability, shipping costs, delivery estimates, promotions, or other information.

We reserve the right to correct errors and update information.

Where an error materially affects an order, we may contact the customer, correct the order, or cancel and refund it where appropriate and legally permitted.

17. PROHIBITED USE

You must not use our Services:

• to conduct payment or chargeback fraud;

Products are subject to the specifications and descriptions provided through our store and normal manufacturing tolerances.

19. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, Kelvetic and its service providers, contractors, representatives, and partners will not be liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, lost revenue, lost data, or similar losses arising from use of our Services or products.

To the fullest extent permitted by applicable law, Kelvetic will not be liable for losses caused by circumstances outside our reasonable control, including carrier actions, customs processing, postal delays, theft following delivery, customer-provided incorrect information, or third-party service interruptions.

Nothing in these Terms excludes liability that cannot legally be excluded.

20. INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to indemnify and hold Kelvetic harmless from third-party claims, losses, damages, and reasonable costs arising from your unlawful use of the Services, material breach of these Terms, fraud, or violation of third-party rights.

21. FORCE MAJEURE

We are not responsible for failure or delay caused by circumstances beyond our reasonable control, including natural disasters, severe weather, war, civil unrest, governmental actions, epidemics, strikes, transportation interruptions, carrier disruptions, customs delays, power failures, telecommunications failures, or major service-provider outages.

22. SEVERABILITY

If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent legally permitted and the remaining provisions will remain effective.

23. GOVERNING LAW

These Terms and contracts with Kelvetic are governed by the laws of Switzerland, without regard to conflict-of-law principles, except to the extent mandatory law requires otherwise.

To the fullest extent legally permitted, disputes relating to these Terms or purchases from Kelvetic shall be subject to the competent courts at Kelvetic's place of business in Switzerland.

Nothing in this provision removes a customer's right to rely on mandatory jurisdiction or consumer protection rules that cannot legally be waived.

24. CHANGES

We may update these Terms from time to time.

The current version will be published on our website with its latest update date.

Updates will apply prospectively except where applicable law permits otherwise.
